1. Scope
These terms and conditions apply to all orders placed via our online shop www.alcanero.com by consumers and businesses worldwide. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

By placing products in the online store, we submit a binding offer to conclude a contract for these items. The contract is concluded when you accept the offer for the goods in your shopping cart by clicking the order button.
3. Language and Contract Storage
The languages available for the conclusion of the contract are German and English. We do not save the full text of the contract. After placing your order, you will receive a confirmation email.
4. Delivery Conditions
We deliver worldwide. Shipping costs are shown at checkout and vary by country and shipping method. Pickup is not possible.
5. Payment
We offer the following payment methods, depending on your country:
- Credit Card (Visa, Mastercard, Amex)
- PayPal
- Shopify Payments (Apple Pay, Google Pay, etc.)
- Klarna
6. Right of Withdrawal
Consumers have the statutory right to withdraw from the contract. Details can be found in our cancellation policy below.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Transport Damage
If goods are delivered with obvious transport damage, please report such faults immediately to the delivery company and contact us: contact@alcanero.com. Failure to make a complaint does not affect your legal rights but helps us file claims with the shipping carrier.
9. Warranty
The statutory warranty laws apply. Please note that Alcantara is a premium textile material and natural wear may occur with regular use. Color changes or wear are not considered defects.
10. Customs & Import
For deliveries outside the EU, additional customs duties, taxes, or fees may apply. These are to be borne by the customer. Please contact your local customs office for details.
11. SMS Service and Marketing
By consenting to Alcanero Accessories' SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within our messages. We will honor any clear opt-out request. Message and data rates may apply.

We may change the number or short code used to send messages. Messages sent to outdated numbers or codes may not be received, and we are not liable for honoring such requests.

12. Dispute Resolution and Arbitration Agreement
You and Alcanero Accessories agree that any controversy, claim, action, or dispute arising out of or relating to these Terms or your use of the Services shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association, under the Federal Arbitration Act.
The arbitration will be conducted by a single arbitrator, and may be held in person, by phone, or via document submission, in Greven, Germany. New York law will apply only if the FAA does not.
You may opt out of this arbitration clause within 30 days of your first purchase by sending written notice to: Alcanero Accessories, c/o Postflex #8979, Emsdettener Str. 10, 48268 Greven, Germany. Your notice must include your name, address, and a clear statement that you decline arbitration. If we do not receive this within the 30-day period, arbitration is mandatory.
13. Class Action Waiver
You agree to bring any dispute as an individual and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over class proceedings.
14. Final Provisions
If any provision of this agreement is or becomes invalid, the validity of the remaining provisions shall remain unaffected. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
